Legalized Marijuana and the Real Estate Industry

On October 11, 2019, Abbott Nicholson Senior Counsel Randolph T. Barker presented “The New ‘Joint’ Tenancy: the Impact of Marijuana Legalization on the Real Estate Industry” to the Washtenaw County Bar Association.  The program explored the complicated issues surrounding the use of real estate for recreational and medical marijuana activity, including commercial uses, and the rights of municipalities, landlords and adjoining owners to restrict those uses.  Randy also briefly discussed business and employment law matters faced by real estate professionals as they relate to listing and showing marijuana properties, assisting clients with acquisition of property intended for marijuana operations, and also the employment of agents and staff who potentially use marijuana or perhaps work under its influence.
