2010 EEO-1 SURVEY DUE BY SEPTEMBER 30, 2010
 
   
  U.S. Equal Employment Opportunity Commission ("EEOC") requires all private employers, i.e., non-governmental employers, to provide a count of their employees by job category and by ethnicity, race and gender.  Employers should use the Employer Information Report EEO-1 ("EEO-1 Report") when filing the information with the EEOC.  The filing deadline for the 2010 EEO-1 Report is September 30, 2010

Not all employers are required to submit this report.  The EEO-1 Report must be filed by companies or "affiliated entities" with 100 or more employees.  Affiliated entities are companies owned or affiliated with another company, or where there is centralized ownership, control or management so that the group legally constitutes a single enterprise and the entire enterprise employs a total of 100 or more employees. 

Filing requirements differ depending on whether the employer is a Single-establishment employer or Multi-establishment employer.  Single-establishment employers (employers doing business at only one establishment) must complete a single EEO-1 Report online or submit a single EEO-1 paper report.  Multi-establishment employers (employers doing business at more than one establishment) must complete online:

 

    • a report covering the principal or headquarters office;
    • a separate report for each establishment employing 50 or more persons;
    • a separate report for each establishment employing fewer than 50 employees or an establishment list showing the name, address, and total employment for each establishment employing fewer than 50 persons, including an employment data grid that combines all employees working at establishments employing fewer than 50 employees by race, sex, and job category; AND
    • a consolidated report.
